Terms and Conditions of Use

By creating an event, joining an event, uploading content, commenting, reacting, or using PixGala in any way, you accept these Terms. If you DO NOT agree, DO NOT use PixGala.

"Content": photos, videos, audio, text, comments, names, images, links, or any material uploaded or shared by Users. "User": any person who accesses, views, uploads, comments, reacts to, or shares Content. "Event Owner / Organizer": the person who creates the event, distributes the QR/link/access code, invites participants, and manages the event.

PixGala is solely a technological tool for third parties (Users) to upload and share content within events. US Memories does NOT: • create the Content, • review or approve the Content before it is published, • validate permissions, consents, releases, or copyrights, • verify participant identities, • control who obtains the QR/link/code, • prevent downloads, screenshots, forwarding, or publication outside the event. The Content is the total responsibility of the person who uploads it and the person who manages the event. PixGala is not responsible for what Users decide to upload, share, or disclose.

By uploading or sharing Content, the User declares and warrants that: • they have all necessary rights, licenses, and permissions, • they have the consent of each person appearing in the Content, • if minors appear, they have verifiable consent from the parent/guardian, • the Content does not violate privacy, image rights, copyright, trademarks, or any applicable law. The User acknowledges that they upload and share Content at their own risk and assumes all civil, criminal, administrative, and financial liability for that Content and its disclosure.

The Event Owner accepts that they are the primary and direct responsible party for: • obtaining releases/consents from participants (especially if minors are involved), • deciding who receives the QR/link/code, • assuming the consequences if that QR/link/code is forwarded or disclosed, • informing their guests that the Content may be saved, downloaded, captured, and forwarded by other participants, • handling internal complaints (for example: "that photo affects me", "delete it", "I don't have permission", etc.). US Memories has no obligation to be an arbiter, mediator, investigator, or judge of disputes between guests.

The User and the Event Owner expressly acknowledge that: • once a guest has access, they may copy or redistribute the Content, • US Memories does not guarantee absolute confidentiality, • any disclosure caused by participants is the responsibility of the Event Owner and/or Users, never of US Memories.

It is prohibited to upload Content that is: • illegal, defamatory, threatening, harassing, or invasive of privacy, • that violates copyrights, trademarks, or image rights, • that includes sensitive information without authorization, • that involves child exploitation or sexual content with minors (zero tolerance).

We may, at our sole discretion, limit access, suspend events/accounts, or remove Content. But we are not obligated to monitor or review everything. The fact that we act (or not) does not create liability for US Memories.

By uploading Content, you grant US Memories a limited, non-exclusive, worldwide license to host, process, compress, transmit, and display that Content solely to operate PixGala (includes temporary technical/backup copies).

PixGala is not permanent storage. We may delete content due to maintenance, failures, security, closures, or policies. Keep your own copies. We do not guarantee recovery.

PixGala is provided "as is" and "as available." We do not guarantee uninterrupted operation or absence of errors.

To the maximum extent permitted by law, US Memories shall not be liable for direct or indirect damages arising from the use of PixGala or third-party Content. If despite everything liability is determined, the maximum total liability of US Memories shall be USD $100 or the amount paid by the Event Owner to US Memories in the last 3 months, whichever is less.

The User and the Event Owner agree to defend, indemnify, and hold harmless US Memories, LLC (owners, employees, contractors, and partners) against any claim, lawsuit, fine, loss, damage, or expense (including attorneys' fees) related to: • Content uploaded, shared, or disclosed, • lack of consents / releases / permissions (including minors), • violation of privacy, image, copyright, or trademarks, • distribution or forwarding of the QR/link/code, • any dispute between event participants.

By accepting these Terms, you agree to receive marketing emails from US Memories (promotions, offers, news, campaigns). You may unsubscribe at any time via "unsubscribe." Even after unsubscribing, we may send operational/transactional emails (security, confirmations, service notices).

These Terms are governed by the laws of the State of Florida, USA. Any dispute shall be filed exclusively in state or federal courts located in Orange County, Florida, and the parties accept such jurisdiction.

We may modify these Terms at any time. Continued use implies acceptance.
